All trademarks and registered trademarks appearing on this site and tours are the property of their respective owners.

By the participation in any of our tours,, the participant as well as any heirs or assignees agree to hold harmless and release, both now and in perpetuity,  All About Charleston LLC (AAC) and its agents, employees, contractors and or representatives from any and all liability, injury, accident, death, harm, financial loss or incidental damages or any other circumstance arising from or that may occur during, immediately preceding or following or is in any way related to participation in said activity, whether or not due to omission, negligence, incompetence, failure or any other reason on the part of or by AAC.  Participant understands that said activity may be physically strenuous, emotionally disturbing and potentially hazardous, and agrees that they are in adequate physical and mental condition to participate as well as adequately outfitted and clothed. AAC are for entertainment purposes only.

The information is provided by AAC and while we endeavor to keep the information up to date and correct, we make no representations or warranties of any kind, expressed or implied, about the completeness, accuracy, reliability, suitability or availability with respect to the website or the information, products, services, or related graphics contained on the website for any purpose. Any reliance you place on such information is therefore strictly at your own risk. Booking Policy


The necessary steps to contract any of our Services are pointed out on the "How to book" page and are outlined in these Terms and Conditions.  In case that there is any difference between the steps on "How to book" page and those below, the latter will be applicable.  All tours are subject to AAC availability. 


The steps to follow are:

 

  • Selection of the desired Service and providing all the information necessary to contract the service in question;

 
  • Reading and agreeing to the present Terms and Conditions.
 
  • Receival of the Reservation Confirmation at the provided e-mail address. This document does not bind you to the contracting any of our Services, nor does it oblige AAC to provide you with the service in question;
 
  • After checking availability, AAC will send you the Booking Pre-confirmation, in which you are to pay the total booking price through PayPal.
 
  • After confirmation of payment, you will receive the final Booking Confirmation. This document is the legal contract between you and AAC and has to be presented at pick-up to our driver and/or tour guide.

 

 

Prices


There are no prices mentioned on our website. Tour prices will be discussed with each client via email or phone.  AAC reserves the right to change these prices at any time before final booking.  Once payment for Services has been recieved, prices are considered "locked in" and will not change before rendering of Services.  A Service is non-contracted until receipt of the final Booking Confirmation.

 


Cancellation Policy


AAC usually has full bookings each day.  Understand that a cancellation is deemed a loss of income for AAC and a breach of contract for Services.  Understanding that unforeseen events do sometimes occur, AAC has developed a fair and equitable cancellation policy.

 

A cancellation or change in number of guests of your reservation must be confirmed in writing and will be acknowledged by AAC. When your reservation is canceled, any payment you have already made may not be fully refundable, depending on the time between receipt of the cancellation and the planned date for the contracted service (referred to below as "tour date"). The percentages below are percentages of the total booking price.


If the cancellation is received at least 21 days before the tour date, a full refund will be given. When a cancellation is made between 20 and 14 days before the tour date, 25% will not be refundable. When a cancellation is made between 13 and 7 days before the tour date and time, 50% will not be refundable. When a cancellation is made between 6 and 2 days before the tour date and time, 75% will not be refundable. When a cancellation is received after 48 hours before the tour date, the total booking price is non-refundable.  These percentages apply to changes in the number of guests (where the tour is based on price per person) as well.


AAC reserves the right to cancel your reservation due to unforeseen circumstances on our part. In case of cancellation by AAC, any amounts paid will be fully refundable.

 


Last Minute Reservations


Last minute reservations will be accepted on a limited basis and based on tour guide availability.  Cancellation of a last minute reservation after receival of the final Booking Confirmation will constitute a non-refundable booking price.

 


Availability and Tour Type


Prices for all tours will be based on the number of people in the touring party.  AAC tries to provide the contracted Service on the day chosen by you. If this is in anyway impossible however, AAC reserves the right book the tour date to any date between your arrival and departure, as provided by you in the booking process and will work with you to ensure simultaneous availability.  AAC also reserves the right to change a tour date if needed and will be obliged to inform you on such a change per e-mail, and you have the right to cancel your reservation if such information is received within 72 hours before the tour date and time. The applicable part of the cancellation policy in this case is that of a full-refund cancellation.  All tours are private tours!


Security, Theft, and Damage

 

AAC cannot be held responsible for any costs resulting from theft of, loss of, or damage to, goods, or personal damage occurring during the time that you use any of our Services.  By contracting any of our Services, you assume the total responsibility of such costs, and that of contracting a travel insurance to cover, to a certain or any amount, these expenses.

 


Privacy Policy


Use of Information
AAC will only use information provided by you for the following purposes:

 

  • processing your reservation order;
  • sending you information about our services;
  • collecting any necessary payments as outlined in the present Terms and Conditions.


Sharing Information
If you have given AAC permission to do so during the booking process, we may send you information about our Services. If you wish, you can unsubscribe at any moment following the instructions as mentioned in the bottom part of any one of such e-mails. Other than as set out above, we will not disclose any of your personal information without your permission unless we are required by law to do so (e.g. if we are required to do so by a court order or for the purposes of prevention of fraud or other crimes).

Please tell me about the "Binding Legal Notice" and "Release" that are hereby incorporated into, but not limited to, All About Charleston LLC ("AAC" - as defined below) or any other websites, emails, invoices (including but not limited to "PayPal"), and any other communications, whether oral, written, or electronic, relating to AAC, THE TERMS OF WHICH I UNDERSTAND AND HAVE FREELY AGREED TO, when booking or participating in AAC tours or services:

All About Charleston LLC, Jeffrey L. Caplinger  and Lisa R. Caplinger, including but not limited to, their tour guides, owners, officers, directors, members, affiliates, contractors, sponsors, partners, representatives, agents, estates, families, and employees, are collectively referred to as "AAC" in this Binding Legal Notice and Release.

You, including but not limited to, you, your representatives, your agents, your group members, your families, heirs,  estate, or anyone acting for or on your behalf, are collectively referred to as "You" or "Your" in this Binding Legal Notice and Release.

YOU UNDERSTAND AND AGREE THAT your use of this website, or of any other information, communication, or advertisements distributed by, on behalf of,  or concerning AAC, constitutes consent to the terms of this Binding Legal Notice and Release. 

YOU UNDERSTAND AND AGREE THAT individuals and/or entities who book any tour or service through AAC, or purchase or use any Gift Certificates relating to AAC, or receive any passes relating to AAC, or transfer any credits relating to AAC, assume the responsibility of communicating the contents of this Binding Legal Notice and Release to all participants, whether they are individuals (including parents and/or legal guardians) and/or entities in any group who participate in any tours or services offered by AAC.

YOU UNDERSTAND AND AGREE THAT you are free to consult an attorney for any guidance you may need with respect to this Binding Legal Notice and Release.

YOU UNDERSTAND AND AGREE THAT you know and understand the scope, nature and extent of the risks involved in participating in AAC tours and services as such services are described on or relating to, AAC website and communications, and that some dangers cannot be foreseen. You understand and agree that these risks include, but are not limited to: walking or traveling in varied weather conditions; climbing up and down public or private stairways and curbs; defects in public or private streets, stairs and sidewalks; proximity to or use of, public or private transportation, vehicles, bicycles and other traffic; inadequate pubic or private lighting; the consumption of any food that may cause or aggravate medical conditions; carelessness or negligence of AAC or other participants' in AAC tours and services; and any person's or entity's, whether public or private, negligent instruction or supervision. YOU UNDERSTAND AND AGREE THAT YOU KNOWINGLY, VOLUNTARILY, FREELY, AND EXPRESSLY CHOOSE TO INCUR ALL RISKS associated with the above, understanding that those risks may include, but are not limited to, your bodily and personal injury, damage to your property, and/or disfigurement or death.

YOU UNDERSTAND AND AGREE THAT YOU HEREBY RELEASE, DISCHARGE, AND HOLD HARMLESS AAC from any and all liability, claims, demands, costs, fees, expenses, or causes of action whatsoever arising out of any damage, loss or injury to you, or your property, or your death, while participating in any AAC tour or service, whether resulting from the negligence or other fault, either active or passive, of AAC or from any other cause. You specifically waive any unenforceability and/or public policy argument that you could make or could be made on behalf of your estate or by anyone who would sue AAC as a result of your participation in AAC's tours or services.

YOU UNDERSTAND AND AGREE THAT you will never institute any lawsuit or cause of action or proceeding against AAC, or initiate or assist in the prosecution of any claim for damages against AAC which you may have by reason of injury to your person or property, or your death, arising from the activities covered by this Binding Legal Notice and Release, whether caused by the negligence or fault, active or passive, of AAC, or from any other cause. You hereby so instruct your heirs, executors, administrators, personal representatives, or anyone else claiming or acting on your behalf. Should any such lawsuit or cause of action or proceeding be instituted against AAC, you agree that AAC shall be entitled to recover from you all attorney’s fees and costs and expenses incurred in the defense of such lawsuit or cause of action or proceeding.
 
YOU UNDERSTAND AND AGREE TO INDEMNIFY, DEFEND, SAVE, AND HOLD HARMLESS AAC against any and all losses, claims, damages, expenses, actions, or proceedings of every kind and character, including attorney’s fees, costs and expenses, which may be presented or initiated by any other person or organization and which arise directly or indirectly from: (i) your participation in or use of AAC's tours or services, whether resulting from the negligence or other fault, either active or passive, of AAC or from any other cause, and/or your breach of this Binding Legal Notice and Release and/or any breach of your representations and warranties set forth in this Binding Legal Notice and Release.  You hereby understand and agree that AAC reserves the right, at its own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification and/or defense by you, in which event you agree to cooperate completely and in good faith with AAC in asserting any available defenses.

YOU UNDERSTAND AND AGREE THAT AAC does not condone the consumption or use of alcoholic beverages and/or any controlled substances.  Certain venues visited by AAC could sell alcoholic beverages.  Consuption of alcoholic beverages and/or controlled substances is not permissisible on any AAC tour.  AAC does not assume any responsibility for the actions of people who choose to consume or use alcoholic beverages and/or controlled substances during the course of any tour or service offered by AAC.

YOU UNDERSTAND AND AGREE THAT AAC assumes no responsibility for the contents of any other websites or oral, written or other materials or communications (regardless of the format in which they appear), which involve or reference AAC, or AAC website, or AAC communications, or AAC tours or services.

YOU UNDERSTAND AND AGREE THAT while AAC has made every effort to insure that the information contained in this website and its promotional materials and any of its communications are accurate, you are aware that such information may unintentionally become incomplete, inaccurate or out of date.  ​​
